In compliance with the duty to provide information set out in Article 10 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), the following information is provided. The website www.eloraculodeifa.com and the mobile application El Oráculo de Ifá are owned by Emeyé, with its registered office at Travesía de Huertas 3, Alcalá de Henares, Madrid, Spain (hereinafter referred to as the Owner).

  2. These terms (hereinafter referred to as the Legal Notice) govern the use of the Owner’s website and the El Oráculo de Ifá mobile application, both of which are made available to the public.

Access to and/or use of the Website and the App grants the status of User and implies full acceptance of the terms and conditions contained herein, as well as, where applicable, the terms established by Google Play and Apple App Store for the distribution of the App. These conditions shall apply regardless of any other contractual conditions that may be applicable.

  1. Use of the Website and the App
  2. www.eloraculodeifa.com and the El Oráculo de Ifá App provide access to information, services, software, databases and other digital content (hereinafter referred to as the Content) owned by the Owner or its licensors.

The User assumes full responsibility for the use of the Website and the App. Such responsibility also extends to any registration required to access certain services or content. During the registration process, the User undertakes to provide accurate, truthful and lawful information. Where a password is assigned, the User shall be solely responsible for maintaining its confidentiality and for using it diligently.

The User agrees to make appropriate use of the Content and services offered through the Website and the App and, by way of example but not limitation, agrees not to:

  • Engage in unlawful, illegal or fraudulent activities, or activities contrary to good faith or public order.
  • Distribute content or propaganda of a racist, xenophobic, illegal pornographic nature, promoting terrorism or violating fundamental human rights.
  • Cause damage to the physical or logical systems of Emeyé, its suppliers or third parties, or introduce or spread computer viruses or any other harmful software capable of causing such damage.
  • Attempt to gain unauthorized access to the accounts of other Users or modify or manipulate their information or communications.
  • Use the Website, the App or any of their contents for commercial, advertising or political purposes, including the sending of unsolicited commercial communications.

The Owner reserves the right to remove any comments, contributions or content that violate respect for human dignity, are discriminatory, racist, xenophobic, pornographic, threaten public order or safety, or are otherwise considered inappropriate for publication.

Under no circumstances shall the Owner be liable for opinions expressed by Users through forums, chats or any other participation tools made available on the Website or the App.

  2. All matters relating to the processing of personal data are governed by the Privacy Policy, which forms an integral part of this Legal Notice.
  1. Content. Intellectual and Industrial Property

The Owner holds all intellectual and industrial property rights over the Website, as well as over all elements contained therein, including but not limited to images, photographs, audio, video, software, texts, trademarks, logos, colour combinations, layout, design, selection of materials, computer programs required for its operation, access and use, either as the Owner or under licence from third parties.

The Owner also holds all intellectual and industrial property rights over the El Oráculo de Ifá App, including, among others, its images, graphics, photographs, sounds, audio, videos, source code, software, database structure, design, trademarks, logos, colour combinations, selection of materials, user interface, access systems and all other elements developed for the application, either as the Owner or under licence from third parties.

The traditional teachings of Ifá, the Odù, patakís, prayers, proverbs and other elements belonging to the cultural and religious heritage of the Yorùbá tradition are used exclusively for educational, cultural and informative purposes. The Owner’s intellectual property rights do not extend to such traditional heritage itself, but rather to the compilation, selection, classification, database structure, translations, commentaries, digital adaptation, software development, user interface design and all original content created for the Website and the El Oráculo de Ifá App.
  5. All rights reserved. Pursuant to Royal Legislative Decree 1/1996 of 12 April approving the revised text of the Spanish Intellectual Property Act, together with any subsequent amendments, the reproduction, distribution, public communication, transformation, systematic extraction of the database, reverse engineering, reuse of content or any commercial exploitation of all or part of the Website or the App, by any means or medium whatsoever, is strictly prohibited without the prior written authorisation of the Owner.
  6. The use of automated data extraction systems (scraping), data mining, artificial intelligence, robots, crawlers or any other technology intended to collect, reproduce, analyse or systematically reuse the contents or database structure of the Website or the App shall require the Owner’s prior written authorisation.
  1. Disclaimer of Warranties and Limitation of Liability
  2. The User acknowledges that the use of the Website, the App, their contents and services is undertaken entirely at the User’s own risk. In particular, and without limitation, the Owner accepts no liability in relation to:
  3. a) The availability, operation, quality or interoperability of the Website, the App, their services or contents.
  4. b) The suitability of the Website or the App for the User’s particular purposes.
  5. c) Any breach of applicable law by the User or by third parties, including infringements of intellectual or industrial property rights belonging to third parties.
  6. d) The presence of malware, viruses or any other harmful software capable of affecting the User’s or third parties’ computer systems. The User is responsible for maintaining appropriate security measures to detect and remove such elements.
  7. e) Any unauthorised access to the contents or services by third parties, including the interception, deletion, alteration, modification or manipulation of messages or communications.
  8. f) The accuracy, completeness, reliability, usefulness or timeliness of the contents and services, or any decisions taken by the User on the basis of such information, notwithstanding the Owner’s reasonable efforts to keep the information up to date.
  9. g) Damage caused to computer equipment during access to the Website or the App, or interruptions resulting from failures in telecommunications networks.
  10. h) Any loss or damage arising from force majeure events or circumstances beyond the reasonable control of the Owner.

Where forums, chats or similar participation spaces are available, Users acknowledge that any opinions expressed are solely those of the individual User who posts them. The Owner accepts no responsibility for any content published by Users through such communication channels.

  1. Amendments to this Legal Notice and Duration
  2. The Owner reserves the right to modify, without prior notice, the Website, the App, this Legal Notice, as well as any content or services provided through them, including their presentation, structure or availability.

These Terms shall remain in force until they are replaced by a new version duly published on the Website or within the App.

  2. Where the Website or the El Oráculo de Ifá App contains links or hyperlinks to third-party websites, the Owner shall have no control over such websites or their contents. Under no circumstances shall the Owner assume any responsibility for the contents, availability, reliability, accuracy or legality of any external website or of the information contained therein. The inclusion of such links shall not imply any association, partnership, endorsement or participation between the Owner and the operators of the linked websites.

  2. The Owner reserves the right to deny, suspend or withdraw access to the Website, the App and/or any of the services offered, without prior notice, either on its own initiative or at the request of a third party, to any User who breaches the provisions of this Legal Notice.

  2. The Owner shall pursue any breach of these Terms and any improper use of the Website or the App by exercising all civil, administrative and criminal actions available under applicable law.
  1. Applicable Law and Jurisdiction
  2. This Legal Notice shall be governed by and interpreted in accordance with the laws of Spain. Any dispute or claim arising out of or relating to this Legal Notice, the Website or the App shall be submitted to the Courts and Tribunals of Madrid (Spain), unless mandatory consumer protection legislation provides otherwise.

Persons under the age of 18 are not authorised to use our services or to provide us with their personal data. Should this nevertheless occur, the Owner shall not be liable for any consequences arising from the failure to comply with this requirement.
